Hunter Valley Coal Chain Coordinator Limited (HVCCC) understands that its Members and their Associates as users of this website are concerned about the privacy, confidentiality and security of information which they may provide to HVCCC. The following explains how HVCCC will manage, use, disclose, store, and dispose of information including Confidential Information collected through or disclosed by this HVCCC website.
HVCCC’s Commitment to Privacy
HVCCC is committed to ensuring the protection of an individual’s privacy pursuant to the Privacy and Personal Information Protection Act 1998 (NSW) (“PPIP Act”), and the Privacy Act 1998 (Cth) as amended and in force from time to time.
HVCCC will collect, manage, use and disclose personal information (as defined in the PPIP Act and other relevant legislation) in accordance with the National Privacy Principles and other relevant legislative requirements. Some of those legislative requirements may be varied, for example by a Code of Practice made under Part 3 of the PPIP Act.
1. When do we collect your information?
HVCCC will only collect an individual’s personal information where and when it directly relates to the provision of services by HVCCC to users of this website and the performance of HVCCC’s business activities, and it is reasonably necessary for that purpose. In general the primary purposes for which HVCCC collects an individual’s personal information include:
(a) performance of HVCCC’s business activities being to run our 7 day per week logistics planning service;
(b) facilitating the timely delivery of the logistics services which we provide to you;
(c) providing you with information about logistics planning and coal chain performance in the Hunter Valley;
(d) contacting you about relevant coal chain capacity issues;
(e) facilitating a logistics request authorised by you.
2. How does HVCCC collect personal information?
The personal information HVCCC collects is obtained from the data included in information which you provide directly to HVCCC or consent to be provided to HVCCC from a third party or obtained through HVCCC’s website browser.
3. What kind of personal information do we collect?
This Privacy & Confidentiality Policy outlines HVCCC’s commitment to you in accordance with the PPIP Act and the Privacy Act 1988 (Cth). The personal information that HVCCC is most likely to hold is your name and contact information. HVCCC also holds non-personal information including Confidential Information relating to the logistics requirements of its Members for the export of coal through the Port of Newcastle.
4. When is information collected by this website?
You can browse through the public sections of this website without registering any information belonging to you. This website collects information about you only when you complete a form on the website and forward it to us or when you enter your password and access a restricted access area.
Your use of this website will determine the amount and type of information that HVCCC collects about you. You agree that the webmaster and administrators of this website have the right to collect this information.
When you visit this website, HVCCC’s server may log the following personal information provided by you or your browser:
(a) your confidential access password;
(b) your email address; and
(c) any personal information you have entered onto this website.
5. Use and Disclosure of Confidential Information
When you provide it with Confidential Information HVCCC will only use and disclose such Confidential Information for the purpose for which you provided it and then strictly subject to and in accordance with the relevant provisions of the HVCCC Constitution and Members Agreement including those provisions relating to Confidential Information of a Member. You agree to information provided by you being used for the purpose for which you provided it in accordance with the relevant provisions of the HVCCC Constitution and Members Agreement.
You agree that HVCCC and each of its Members have certain rights to use and apply and disclose certain types of information you have entered onto the HVCCC website for the purpose for which it was disclosed to HVCCC and otherwise in accordance with the relevant provisions of the HVCCC Constitution and Members Agreement including those provisions relating to Confidential Information of a Member. If you are not familiar with those provisions you should seek advice regarding the HVCCC Constitution and Members Agreement.
HVCCC reserves the right to use or disclose any personal information as needed to satisfy any law, regulation or legal request or to co-operate in any law enforcement investigation.
If you advise us of any errors in the information you have provided, we will make reasonable efforts to correct the errors so that the information is accurate, complete and up-to-date.
HVCCC does not sell information to any third parties. Your name and address details will not be added to a mailing list without your consent.
6. Cookies and IP address
When you visit this HVCCC website, our server may log the following non-personal information provided by your browser:
(a) the type of browser and operating system you are using and the previous site you visited;
(b) your server’s IP address (a number which is unique to the machine through which you are connected to the internet - usually one of your employer’s machines);

We do not use “cookies” for any purpose other than to store the sites and databases a user has selected. Most browsers are initially set up to accept “cookies”. However it is possible some parts of the HVCCC website will not function properly if you do so; and
(d) the date and time of your visit, which parts of our website you visited, and any documents you downloaded.
You agree that the webmaster and administrators of the HVCCC website have the right to record this Information. We only use information collected by our server to generate statistics and analyse site activity.
7. Email Address
HVCCC may maintain your email address together with other business contact details on its database.
HVCCC may use your email address to provide you with information in relation to weekly coal chain capacity forecasts, major maintenance events, performance reports, newsletters and conference papers. Your e-mail address may also be used for confirming your registration details and password (and for sending new passwords should you forget your current password).
If you wish to discontinue email communication with HVCCC, please advise us by contacting the webmaster by email at info@hvccc.com.au and placing REMOVE in the Subject Line. Until we receive an email from you instructing otherwise, we will assume that you wish to continue receiving regular email communications from HVCCC.
8. Keeping Information up to date
Information may be kept by HVCCC until it is outdated or no longer required after which time it will be destroyed. If the information HVCCC holds changes, please contact us so that we may update the information. We may also make contact from time to time to confirm the information we hold is still correct.
9. Storage of Information
HVCCC stores information in electronic or hard copy form (or both) in either lockable storerooms or, in the case of electronic information, by password protection. In both cases only authorised HVCCC employees and contracted personnel trained in the proper and lawful handling of such information are able to access that information. HVCCC employees follow generally accepted prudent standards of technology and operational security. Please note that, despite the high level of security installed on our website, HVCCC cannot guarantee that any e-mail is secure.

This HVCCC website uses encryption for secure transmission of personal information over the internet. You should recognize that there are risks in transmitting information across the internet. Accordingly, any information transmitted across the internet is at your own risk.
11. Amendments to Privacy & Confidentiality Policy
HVCCC will not unilaterally vary this Privacy & Confidentiality Policy without the approval of its Members as required by the HVCCC Constitution and Members Agreement.
